Boehner rips bid to regulate Internet

NASHVILLE, Tenn. | House Speaker John A. Boehner lashed out against efforts to regulate Internet traffic before an audience of evangelical Christian media leaders and pointedly responded to President Obama by comparing the challenge of the burgeoning national debt to the Sputnik-era space race.

In a speech to religious broadcasters that received a sustained ovation at his conclusion, he said free expression is under attack by a power structure in Washington populated with regulators who have never set foot inside a radio station or a television studio.

“We see this threat in how the FCC is creeping further into the free market by trying to regulate the Internet,” Mr. Boehner said.

“The last thing we need, in my view, is the FCC serving as Internet traffic controller, and potentially running roughshod over local broadcasters who have been serving their communities with free content for decades,” he said to loud applause from members of the National Religious Broadcasters, a trade group holding its annual convention here.

Upholding the Defense of Marriage Law

Oath of office of the President of the United States, “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

Doesn’t this oath require the president to uphold all the laws and regulations that have been passed by the Congress and signed by the president that held office?  If that isn’t the expectation of all of our presidents then why do we have the three parts of government?  Those three are legislative, executive, and judiciary.  It has been accepted practice that the judiciary branch of government, in the form of the Supreme Court, is the final authority on the legality of any law.

Does the Department of Justice Have an Obligation to Defend the Defense of Marriage Law?  If you accept the above method of our system of governance then the answer must be YES!

Without a process we have no system of justice.

Freedom of Speech or Mob Rule

The question is: Does freedom of speech include the right to disturb a meeting through vocal protests? Does the fact that this disturbance was conducted by Muslims against the Israeli ambassador have any bearing?

SANTA ANA, Calif. (AP) — A group of Muslim students accused of disrupting a speech by Israeli ambassador Michael Oren at the University of California, Irvine, were charged Friday with misdemeanor conspiracy counts, ending speculation about what would come from their actions nearly a year ago.

The 11 students each face one count of misdemeanor conspiracy to disturb a meeting and one count of misdemeanor disturbance of a meeting, the Orange County district attorney’s office said. If convicted, they could face anything from probation and community service to six months in jail.

The students were arrested Feb. 8, 2010, after shouting and protesting during Oren’s speech on U.S.-Israeli security, forcing the diplomat to stop his remarks for 20 minutes. Eight of the students were from UC Irvine, and three were from the nearby campus of the University of California, Riverside.

Muslim students from the Irvine school protested outside the district attorney’s office earlier this week after word leaked that a grand jury had been convened in the case.

Jacqueline Goodman, an attorney for all 11 defendants, said they would plead not guilty at an arraignment scheduled for March 11.

District Attorney Tony Rackauckas defended his decision Friday, saying the protest was a pre-meditated attempt to quash the speaker and prevent the 500 to 700 people gathered there from hearing his remarks.

That made the incident about more than free speech, he said.

“This is a clear violation of the law, and failing to bring charges against this conduct would amount to failure to uphold the Constitution,” he said in a statement. “We must decide whether we are a country of laws or a country of anarchy. We cannot tolerate a pre-planned violation of the law, even if the crime takes place on a school campus and even if the defendants are college students.”

Goodman said that just because the district attorney can bring charges doesn’t mean he should, particularly in this case where the students protested peacefully and didn’t resist arrest.

“The district attorney enjoys wide discretion as to which crimes he’s going to choose to prosecute. We don’t prosecute every crime ever committed. We don’t have the unlimited resources to do that,” Goodman said. “It becomes very dangerous to a democracy when we allow the district attorney to prosecute a peaceful protest on a campus based on the contents of that speech.”

The American Civil Liberties Union of Southern California said it is “deeply troubled” by the decision and called on the district attorney to dismiss the charges immediately.

“We are unaware of any case where a district attorney pressed criminal charges over this type of nonviolent student protest,” the ACLU said in a statement. “The district attorney’s action will undoubtedly intimidate students in Orange County and across the state, and discourage them from engaging in any controversial speech or protest for fear of criminal charges,” the statement said.

Many of the defendants are top students applying to medical schools or pursuing master’s degrees, said Hamza Siddiqui, a senior at Irvine majoring in political science.
“This is beyond ridiculous,” he told The Associated Press in a phone interview. “They have a whole future waiting for them, and this little minor incident has a chance of ruining their future.”

The incident was captured on video and enflamed tension between Muslim and Jewish students at the university, which has already run high for several years.

The university revoked the Muslim Student Union’s charter for one year and placed it on probation for another year after launching its own investigation. In September, the school softened the sanctions by restoring the group’s charter effective Dec. 31, but it added a year of probation and 100 hours of community service.

Cathy Lawhon, a university spokeswoman, has said the university has completed its disciplinary process and has no connection to the district attorney’s investigation.

Freedom of Speech

Freedom of speech does not justify bad manners.

WordPress.com provides a platform for people everywhere to express their opinion. I just suggested yesterday that perhaps it’s time to riot in the streets of America. No one has knocked on my door telling me that I can’t write that. I can criticize the president of the United States and call him names without fear of retribution. This freedom of expression is now accepted by most western nations. It includes the right to demonstrate, pray, and speak out without fear.

There are of course some limitations. Most obvious is yelling “fire” in a theater or inciting a mob.

Eleven Arabic students in Orange County, California at UC Irvine have been the object of a grand jury investigation that could lead to criminal charges for disrupting a speech by the Israeli ambassador last year.

Protesters at the University of Ottawa prevented Ann Coulter from giving a speech on March 23, 2010. Ms. Coulter said she has been speaking regularly at university campuses for a decade. While she has certainly been heckled, she said this is the first time an engagement has been cancelled because of protesters.

In both of these instances bad manners prevailed over reasonable discourse. Trying to stop someone from speaking because you disagree with their point of view is not a legal regulation. It’s refusing to accept the fact that there are differing opinions.

Zakaria reported that 30% of all guns in the world are in the United States.  It’s no surprise that 50% of all new gun sales are in the United States.
 
Is it any wonder that gun deaths are reported every day in the United States?  Have our second amendment rights made us safer?

Why Every 30-year-old Needs a Will

Part of any successful financial plan is ensuring you have a  will. While this topic is generally discussed in one’s later years, it’s never too early to start planning for the future — even if it does seem a little morbid.

Young people often disregard wills because they lack assets of significant value. Nevertheless, preparing a will while in your twenties or thirties is the one of the most unselfish acts you can do for the people you leave behind.

Jeanette Brox, a Certified Financial Planner, has heard countless stories of families battling over the possessions of deceased relatives. She has even seen family members fight over teacups. By having a will in place, you help reduce potential family feuds over property. In turn, this will make the grieving process a little easier.

According to California law, if you die without a will, a court-appointed trustee will decide how your estate is distributed. But every American state and Canadian province has its own set of rules, so make sure you do your homework.

For example, I own a condo with my girlfriend. Legally, she is not considered my spouse, so if I die without having prepared a will, my share of the property will be awarded to my parents and not my girlfriend.

If you don’t want to pay for a professionally prepared will a hand written will (called a  holographic will) is acceptable in most states and provinces. While it is generally recommended to have a legal service or lawyer prepare your will, a holographic will may be worth considering if funds are tight.

 
Holographic wills: the free will

A holographic will is a handwritten letter, created and signed by the person who wrote it – the  testator — and has no costs. To make a holographic will, write out by hand how you want your possessions to be handled after your death. You should consider documenting who receives specific items, and who receives any remaining, unmentioned items. You must then sign and date the document.

Try to be as specific as possible will and avoid using any blanket statements. This will help prevent confusion and arguments down the road.

The professional route

You may also choose to have your will professionally drafted and notarized by a lawyer for a fee. Not all states and provinces require notarization.  To minimize costs it is recommended  you do the following before meeting with a lawyer:

– Create an inventory of your assets and liabilities

– Decide what you want to leave and to whom

– Think about how you want your loved ones to use your assets. If an asset is going to someone young and irresponsible, consider putting it in trust so it is awarded when they are older.

– Consider that items received through an estate may be subject to tax. Consult a Certified Financial Planner for more information.

‘You’re dead!’ victim yells at Tea Party spokesman

David Gregory asked in today’s Meet the Press round table, “Could the events in Arizona change our attitudes about security and civility in politics?”

Well, this isn’t what anyone hoped would happen next: A week after the deadly shooting in Tucson, Arizona, a man who had been shot at the scene made a death threat against a Tea Party spokesman at a town hall event sponsored by ABC News. The man, J. Eric Fuller, was reportedly irritated by the remarks of two of the event’s speakers, Republican Rep. Terri Proud and Tucson Tea Party spokesman Trent Humphries. He snapped a picture of Humphries and said, “You’re dead.” Police immediately escorted him from the room and charged him with threats, intimidation, and disorderly conduct. The event, hosted by Christiane Amanpour and taped for an ABC News special, was titled, After the Tragedy: An American Conversation Continued.

Americans, it appears, have not learned anything.  Conservative talk show hosts and their like thinking guests continue to speak in the same way as do the liberal hosts.  Of course both sides claim the mantle of civility.

Congresswoman Giffords is not the first representative in recent years to be impacted by the use of guns.  California Senator Dianne Feinstein was in her office as president of San Francisco County when she heard the gun shots that killed Mayor George Moscone in 1978.

The use of weapons is nothing new in America.  It’s been going on since the America won its freedom from Great Britain.  Remember the duel between Alexander Hamilton and Aaron Burr? In just a few days or weeks we will all have moved on to the next issue.

Second Amendment Rights!

We wonder why there is so much gun violence in this country.

Carefully avoided in the tragic killing of six people in Tucson, Arizona and the shooting of Congresswoman Gabrielle Giffords is any discussion of gun control.  Barack Obama certainly doesn’t want to take on another adversary.  That would be the NRA.

Oh yes, we all have our second amendment rights!  Sarah Palin creating a map of Tea Party targets and placing a gun scope view over each person she wants voted out of office.  Sharron Angle, the Nevada Tea Party candidate who ran against Harry Reid said the public would bring down an out-of-control Congress with “Second Amendment remedies.”  Finally we have the Youtube video of Florida Republican Representative Allen West’s selection of fiery conservative radio talker Joyce Kaufman to be his Chief of Staff.

The politicians are more responsible for the their lack of solutions to the question of how to address the second amendment in the 21st century.  Just  shoot to kill your enemies is their answer.  Just listen to Senator Lamar Alexander on today’s “State of the Union”.  From Virginia Tech to the Safeway parking lot in Tuscon the killing will go on.  All bow to the NRA!!

Promote the General Welfare

Key Words that are in the preamble to the United States Constitution.   I have put them in bold type.

We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America.

Perhaps some of our Representatives and Senators haven’t read the constitution or maybe they have forgotten the words.  For now we have a population of 308 million people and 43 million of them need food stamps to survive.  That is 14% of our population.  The USDA and the U.S. Census is the source of this information.

While those people must resort to the use of food stamps Businessweek magazine, in their final issue of this year, graphically defined the unemployed, partially employed, and those who have given up searching for a job at 17% of the work force.

Thus in an act of goodwill the G.O.P. has agreed to extend unemployment benefit programs for millions of Americans along with an extension of low taxes to millionaires and billionaires.

The benefit to America’s unemployed by the recent Obama tax deal, I predict, will be nothing.  The wealthy and big corporations will keep earning profits thanks to their investments and products made elsewhere.  Incentives to increase American employment are too few to impact the current official 9.8% unemployment rate.

In two years the president will be faced with the choice of extending the lower taxes for the rich during a re-election campaign.  There is no likely way those taxes will be increased.    

Both Congress and the president have abdicated their responsibility to promote the general welfare.
