In the U.S. legal system, there is a principle that compels judges to respect the precedent established by prior decisions on similar cases. This principle is known as “stare decisis” (Latin). This means that courts should adhere to precedent, and not stir the pot on matters already settled.

The above explanation copied from legaldictionary.net explains the reason Supreme Court Chief Justice John Roberts voted with the four “liberal” judges on the Supreme Court in blocking Louisiana’s anti-abortion law. Precedent was set by the striking down a similar law passed by Texas and the Supreme Court’s ruling in Roe versus Wade. Jeffrey Toobin, a legal analyst on CNN, explained this in this linked video.

Our legal system is derived from United Kingdom common law and has been adopted by most of the world. Unfortunately that was the reason laws allowing separate but equal in the schools and other Jim Crow laws took decades to overturn.

Jim Crow laws were state and local laws that enforced racial segregation in the Southern United States. These laws were enacted in the late 19th and early 20th centuries by White Democratic-dominated state legislatures to disenfranchise and remove political and economic gains made by Blacks during the Reconstruction period. The Jim Crow laws were enforced until 1965.

“…One nation under God with liberty and justice for all.”

I am struck with the hanging of American flags in my neighborhood.  That is good.  The pledge recited to the flag is not a pledge to the government but to our society ending in the words  “…One nation under God with liberty and justice for all.”
 

In my opinion the current marches around this country are demands for justice.  That is what makes this weekend so important.  Sadly the message has not been heard by many Americans.

‘We are witnessing the consequences of three years without mature leadership’

(CNN) Former Secretary of Defense James Mattis, a retired Marine Corps general, castigated President Donald Trump as “the first president in my lifetime who does not try to unite the American people” in a forceful rebuke of his former boss as nationwide protests have intensified over the death of George Floyd.

“Donald Trump is the first president in my lifetime who does not try to unite the American people—does not even pretend to try. Instead he tries to divide us,” Mattis said.

“We are witnessing the consequences of three years of this deliberate effort. We are witnessing the consequences of three years without mature leadership. We can unite without him, drawing on the strengths inherent in our civil society. This will not be easy, as the past few days have shown, but we owe it to our fellow citizens; to past generations that bled to defend our promise; and to our children.”His pointed remarks follow more than a week of nationwide protests across the country calling for justice for Floyd, a black man who was killed last week by a white police officer in Minneapolis. In response, Trump earlier this week declared himself “your president of law and order” and vowed to return order to American streets using the military if widespread violence isn’t quelled.

 

The comments from Mattis are a significant moment for a man who has kept mostly silent since leaving the administration. The retired Marine general had been pressed many times to comment on Trump, troop policies, the Pentagon, and other current events and had always refused because he didn’t want to get involved and be a contradictory voice to the troops. Instead, Mattis always insisted he had said everything he wanted to say in his resignation letter.

And until a few days ago he had privately held to that view, but Mattis has become so distressed by the events of the last week that his views on speaking out changed.

The remarks will be a significant moment for many service members who idolize the former defense secretary, who — despite a career based on loyalty and respect for the military chain-of-command — is sending troops the message that the country can unite without the President’s lead.

The message comes after days of increased military presence in Washington. National Guardsmen and federal law enforcement have been stationed around the nation’s capital in a show of force not seen in recent memory. Federal law enforcement officers violently broke up peaceful protests in front of the White House on Monday, apparently so Trump could stage a photo-op at a church across the street from Lafayette Square, where protesters had gathered.

The former secretary, who resigned from Trump’s Cabinet, also indirectly criticized current Defense Secretary Mark Esper’s use of the word “battlespace” in reference to American cities.

“We must reject any thinking of our cities as a ‘battlespace’ that our uniformed military is called upon to ‘dominate,’ ” Mattis said. “At home, we should use our military only when requested to do so, on very rare occasions, by state governors. Militarizing our response, as we witnessed in Washington, D.C., sets up a conflict—a false conflict—between the military and civilian society.”

“It erodes the moral ground that ensures a trusted bond between men and women in uniform and the society they are sworn to protect, and of which they themselves are a part. Keeping public order rests with civilian state and local leaders who best understand their communities and are answerable to them.”

Esper on Wednesday acknowledged his use of the word “battlespace” was not meant to indicate any conflict with Americans, but claimed he used a military term of art. Esper also specifically rejected the use of active duty forces in a law enforcement role at this time.

But Mattis directed most of ire at Trump saying “Never did I dream that troops taking that same oath would be ordered under any circumstance to violate the Constitutional rights of their fellow citizens—much less to provide a bizarre photo op for the elected commander-in-chief, with military leadership standing alongside.”

Donald Trump is No Conservative

What happened to the conservative Republican Party?

“America vs. Socialism” was the theme of the Conservative Political Action Conference this past February. “One of the most serious challenges our countries face is the specter of socialism. It’s the wrecker of nations and the destroyer of societies,” Trump said during his 35-minute address to the General Assembly on 09/24/19. But times have changed and now Trump is the promoter of give aways and subsides.

Thanks to the coronavirus, the United States is heading into a recession. 26.4 million people have applied for unemployment insurance aid since the country has been shut down. More high unemployment numbers may be on the horizon. Trump’s solution to high unemployment and closed businesses was ask congress to spend enough money to help everyone and every company pay their bills.

$1200 to each adult and $500 to each minor is being given to every legal resident and $600 per week to every person laid off from their job in addition to each states standard unemployment benefit for up to four months.

Businesses are to receive low interest loans. Some with strings attached and some with no strings.

This is the best example of a form of socialism that I can imagine. Democrats are delighted to go along with the big spending. Bernie Sanders, an avowed Democratic Socialist, is seeing his ideas being instituted. Donald Trump said there will never be socialism in America has proven to be the person most responsible for fulfilling Sanders ideas.

For sure it is Keynesian economics. Keynesian economics is an economic theory of total spending in the economy and its effects on output and inflation. John Maynard Keynes advocated for increased government expenditures and lower taxes to stimulate demand and pull the global economy out of the Great Depression. Keynes argued that an interventionist government could help smooth out recessions by using fiscal policy to prop up aggregate demand. Strategic government spending could spur consumption and investment, argued Keynes, and help alleviate unemployment. Keynes’s theories gave rise to a new dominant paradigm in economic thought, which was subsequently dubbed Keynesian economics. While still popular, some have argued that Keynesian economics has provided a pseudo-scientific justification for short-sighted elected politicians to run fiscal deficits and accumulate massive levels of government debt.

Where is Peter Navarro and Larry Kudlow? If they are supporting Donald Trump actions now they have realized that John Keynes was right all along.

Thank goodness Donald Trump never heard of Milton Friedman.

President’s intelligence briefing book repeatedly cited virus threat

 

This is a disturbing report that was published in the Washington Post.  The entire report recites Donald Trump’s dealing with the coronavirus. The complete article is here The first 11 paragraphs are the most important and are posted, unabridged, here.  Trump is reported to be a big watcher of television.  If only the President’s Daily Briefing had been broadcast perhaps America’s response to the virus would have been different.

U.S. intelligence agencies issued warnings about the novel coronavirus in more than a dozen classified briefings prepared for President Trump in January and February, months during which he continued to play down the threat, according to current and former U.S. officials.

The repeated warnings were conveyed in issues of the President’s Daily Brief, a sensitive report that is produced before dawn each day and designed to call the president’s attention to the most significant global developments and security threats.

For weeks, the PDB — as the report is known — traced the virus’s spread around the globe, made clear that China was suppressing information about the contagion’s transmissibility and lethal toll, and raised the prospect of dire political and economic consequences.

But the alarms appear to have failed to register with the president, who routinely skips reading the PDB and has at times shown little patience for even the oral summary he takes two or three times per week, according to the officials, who spoke on the condition of anonymity to discuss classified material.

The advisories being relayed by U.S. spy agencies were part of a broader collection of worrisome signals that came during a period now regarded by many public health officials and other experts as a squandered opportunity to contain the outbreak.

As of Monday, more than 55,000 people in the United States had died of covid-19.

The frequency with which the coronavirus was mentioned in the PDB has not been previously reported, and U.S. officials said it reflected a level of attention comparable to periods when analysts have been tracking active terrorism threats, overseas conflicts or other rapidly developing security issues.

A White House spokesman disputed the characterization that Trump was slow to respond to the virus threat. “President Trump rose to fight this crisis head-on by taking early, aggressive historic action to protect the health, wealth and well-being of the American people,” said spokesman Hogan Gidley. “We will get through this difficult time and defeat this virus because of his decisive leadership.”

The Office of the Director of National Intelligence is responsible for the PDB. In response to questions about the repeated mentions of coronavirus, a DNI official said, “The detail of this is not true.” The official declined to explain or elaborate.

U.S. officials emphasized that the PDB references to the virus included comprehensive articles on aspects of the global outbreak, but also smaller digest items meant to keep Trump and senior administration officials updated on the course of the contagion. Versions of the PDB are also shared with Cabinet secretaries and other high-ranking U.S. officials.

One official said that by mid- to late January the coronavirus was being mentioned more frequently, either as one of the report’s core articles or in what is known as an “executive update,” and that it was almost certainly called to Trump’s attention orally.

The administration’s first major step to arrest the spread of the virus came in late January, when Trump restricted travel between the United States and China, where the virus is believed to have originated late last year.

Quest Diagnostics had about 160,000 coronavirus test orders waiting to be processed on March 25, which amounted to about half of the 320,000 total orders for the tests the company had received up to that date, according to Quest internal materials obtained by CNN.

Maryland Gov. Larry Hogan (R) on Tuesday rejected President Donald Trump’s claim that there’s no longer a shortage of coronavirus tests, calling the assertion “just not true” and warning that no state has enough tests.

New Orleans Mayor appearing on MTP Daily said they needed 5,000 ventilators but have received about 150.

CBS News obtained audio of a call Monday between Pres. Trump and rural state governors about coronavirus. After Montana Gov. Steve Bullock discusses difficulty getting testing equipment, Trump says, “I haven’t heard anything about testing being a problem.”

At Tuesday’s coronavirus briefing President Trump said that there are almost 10,000 ventilators being “held back” from distribution because “the surge is coming.” Why would the government hold back ventilators that are needed now?

What is the first order of business in today’s briefing is an issue warning of deploying naval vessels searching for drug cartels trying to bring drugs into the United States. It was at that point that I turned off the press briefing and so did MSNBC.

Donald Trump is headed for a Second Term

Former Vice President Joe Biden is the likely Democratic Party nominee.  That will result in a  second term for Donald Trump.

The reason for that outcome is the fact that Joe Biden is: 1) a replica of Hilary Clinton.  Clinton offered no reason to elect her while Trump offered many plans.  2) Biden is a terrible campaigner who stumbles repeatedly at his rallies.  Biden’s staff has kept him hidden from most television interviews.  His appearance on The View was light on tough questions. The View ladies did not ask one serious question.  Instead they had Biden’s wife appear with him.  Chuck Todd’s Meet the Press interview on March 1 of similarly light on serious issues.

The only thing that can derail Trump’s re-election is a serious recession or his mishandling of the coronavirus epidemic.
